In the judgement, the Court upheld the decision of the Election Petition Tribunal which upturned the Election of Senator Jubril Wowo representing the FCT Senatorial zone.
The Court gave its verdict without the application of the Respondent, Alhaji Idako of Progressive Action Congress, because he did not file on time.
The appellant court held that the election did not substantially comply with, the electoral act, stressing that from the evidence before it, the respondent was wrongfully excluded.
It therefore ordered that a bye election be conducted in the FCT Senatorial zone within ninety days.
Meanwhile, the Presidential Election Petition Tribunal has fixed judgement for a date to be announced later to all the parties involved.
The Court fixed the date after listening to argument of all the parties in the matter.
Counsel to President Yar’Adua and Vice President Jonathan, Mr Wole Olanipekun, urged the court to discountenance the petitioners’ application for not providing substantial evidence, a position supported by the INEC lawyer, Mr Kanu Agabi.
In similar argument, Counsel to Alhaji Atiku Abubakar, the AC Presidential candidate, Professor Alphred Kazimo stressed that the court could not uphold an election, which substantially violated the electoral act by using un-serialized, ballot papers and where results were announced before they were collated.
Correspondent reports that the Tribunal in a ruling rejected an application by Professor Kazimo to tender a document on the conduct of the election in the country by INEC.
